Terms & Conditions

These Terms apply to photography services, image delivery and optional digital products supplied by Leon Blakk Photography. The separate Model Agreement & Release applies whenever a person participates as a model.
1. Provider and scope
The provider is Leon Blakk Photography, operated by Leon Blakk. Current business and contact details are stated in the Impressum. Questions about these Terms may be sent to leonxblakk@gmail.com.
These Terms apply unless an individual written offer or agreement expressly states otherwise. Individually agreed terms take priority. Mandatory consumer rights remain unaffected.
2. Enquiries and contract formation
Website descriptions, portfolio pages and request forms are invitations to enquire and are not by themselves binding offers. Submitting a booking or Extended Library request does not confirm a booking or create a payment obligation.
A contract is formed when the customer accepts an individual written offer from the Photographer, when the Photographer issues an express booking confirmation following the customer's order, or when both parties otherwise confirm the essential project details in writing. Those details include the service, price, payment schedule, deliverables and delivery timing.
Before a consumer places a binding paid order, the final consumer price—including any VAT legally applicable at the time—and any unavoidable additional costs will be provided. No additional VAT is added to a displayed total price. A payment obligation will not be created through a website button unless that button clearly identifies the payment obligation.
3. Photography services and delivery
The agreed shoot scope, date, location, duration, team, deliverables and price are defined in the individual confirmation. Portfolio examples illustrate style but do not guarantee identical results.
Unless otherwise agreed, the Photographer selects the images suitable for delivery and applies the editing appropriate to the booked service. Rejected frames, duplicate frames, test exposures and RAW files are not deliverables.
The number of final images and the delivery date or delivery period must be stated in the individual confirmation. If a customer delays a required selection, approval or payment, the delivery period is extended accordingly.
TFP collaborations are governed by the project confirmation and the Model Agreement & Release. The agreed final TFP selection is supplied without a fee as consideration for the model's participation.
4. Private Extended Library
The Extended Library is an optional, separately priced digital add-on for eligible participants in a completed shoot. It is not included in a TFP collaboration or paid session unless the individual confirmation expressly includes it.
- The offer will state the total price, the actual or maximum image count, delivery method and access period before purchase.
- “Up to 300” is a maximum, not a guarantee of 300 images. The available number depends on the shoot and the Photographer's technical and editorial review.
- Library photographs are curated and lightly retouched. They are not equivalent to the smaller, fully retouched final selection. RAW files, rejected frames and technically unsuitable images are excluded.
- Access is private and intended only for the named purchaser or authorized shoot participants. Login details and gallery links may not be published or shared with third parties.
- The purchaser must download permitted files during the stated access period and maintain their own backup. No permanent online archive is promised.
- Photographs involving another identifiable participant will only be provided where the Photographer is entitled to do so and may be withheld to protect that person's rights or agreed boundaries.
The statutory rights relating to non-delivery, defects and lack of conformity of a digital product remain unaffected.
5. Copyright and customer licence
The Photographer retains copyright in all photographs. After full payment, the customer receives the non-exclusive usage rights stated in the individual confirmation.
Unless a broader licence is expressly agreed, delivered photographs and Extended Library files may be used personally, including in a private portfolio and on the customer's own non-commercial social-media profiles. They may not be sold, sublicensed, supplied to a brand or agency for advertising, used for paid promotion, entered into stock libraries, minted as digital collectibles, or materially altered beyond reasonable cropping and platform formatting.
Commercial, brand, advertising, press and third-party uses require a separate written licence. Copyright notices, metadata and watermarks may not be removed where present.
6. Prices and payment
The final consumer price, including any VAT legally applicable at the time, together with the deposit and payment dates, is specified in the individual offer. The invoice will state the VAT treatment required for the business that issues it. Invoices are payable by the stated due date. The Photographer may withhold high-resolution delivery or gallery access until the corresponding payment is received.
Optional costs such as travel, permits, studio rental, styling, prints or additional retouching are chargeable only where disclosed and agreed before they are incurred.
7. Consumer right of withdrawal
Withdrawal information
If a consumer concludes a distance or off-premises contract, the consumer generally has the right to withdraw within 14 days without giving a reason. The period begins on the day the contract is concluded. To exercise the right, the consumer must send a clear statement of the decision to withdraw to Leon Blakk Photography using the contact details in the Impressum or by email to leonxblakk@gmail.com. Sending the statement before the period expires is sufficient.
If validly withdrawn, payments received under the withdrawn contract will be reimbursed without undue delay and no later than 14 days after notice of withdrawal is received, using the original payment method unless otherwise agreed.
For paid digital content supplied before the 14-day period ends, the right of withdrawal expires only where the consumer expressly requests immediate supply, expressly acknowledges losing the withdrawal right when supply begins, and receives the required contract confirmation. These declarations will be requested separately; accepting these Terms alone does not waive the right.
Where a consumer expressly requests that a service begin during the withdrawal period and later withdraws before completion, the consumer may owe the proportionate value of the service already performed where the statutory conditions are met.

8. Rescheduling and cancellation
Project-specific cancellation, deposit and rescheduling conditions will be stated in the individual offer. Nothing in those conditions limits a statutory right of withdrawal or other mandatory consumer right.
Either party must promptly disclose circumstances that make the shoot unsafe, unlawful or materially different from the agreed concept. The Photographer may stop or decline work that crosses an agreed boundary or creates an unreasonable safety risk.
9. Defects and liability
Statutory rights for defects and non-conforming digital products apply. Customers should report delivery problems promptly so they can be investigated and remedied.
The Photographer has unlimited liability for intent and gross negligence, injury to life, body or health, fraudulently concealed defects, and liability that cannot legally be limited. For slight negligence involving an essential contractual duty, liability is limited to the typical foreseeable damage. Otherwise, liability for slight negligence is excluded to the extent legally permitted.
10. Governing law and final provisions
German law applies. If the customer is a consumer habitually resident in another country, mandatory consumer protections of that country remain unaffected. Statutory rules determine the competent court; no exclusive venue is imposed on consumers.
If one provision is invalid, the remaining provisions continue to apply. Changes to these Terms apply only to contracts concluded after the updated version is made available, unless the parties expressly agree otherwise.
